Often in the family law process people confuse property settlement and divorce.  The divorce process is something that occurs after you have been separated from your partner for a period of over 12 months.  All parties are able to start the process of a property settlement upon their separation however they are not able to make any application to the Court for a Divorce Order until they have been separated for 12 months.
